1. About Switch

Switch is a service-booking platform that helps customers discover and book services offered by independent merchants — including fitness studios, wellness practitioners, personal trainers, and other service providers. These Terms & Conditions ("Terms") govern your access to and use of the Switch platform, website, and mobile application (collectively, the "Platform").

By creating an account or using the Platform, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please discontinue use of the Platform.

2. Eligibility

You must be at least 13 years of age to use Switch. By using the Platform, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. Your Account

You are responsible for keeping your login credentials secure. Do not share your account with others.
You agree to provide accurate and up-to-date information when creating your account.
You are responsible for all activity that occurs under your account.
Notify us immediately at support@switchapp.in if you suspect unauthorised access.

4. The Switch Platform

Switch provides the technology infrastructure that enables customers to discover, book, and pay for services listed by merchants. Switch acts as a marketplace facilitator — we are not the provider of any service listed on the Platform.

Each merchant is an independent business responsible for the delivery, quality, safety, and conduct of their services. Switch takes pride in partnering with quality merchants and continuously works to raise the bar through merchant reviews and standards — but the ultimate responsibility for service delivery rests with each merchant.

5. Bookings & Cancellations

When you book a service through Switch, you are entering into an agreement directly with the merchant. Switch facilitates the transaction and provides booking management tools.

Cancellation and refund policies are set by each merchant and displayed on their profile page. We encourage you to review these policies before booking. Where a merchant's policy permits a refund, Switch will process that refund promptly on the merchant's behalf.

Switch may, at its discretion, assist in resolving disputes between customers and merchants in the spirit of a fair experience for all parties.

6. Payments

Payments are processed securely through our authorised payment partners.
All prices are displayed inclusive of applicable taxes unless stated otherwise.
Switch uses your payment details solely to process transactions you authorise. We do not store full card numbers.
In the event of a failed transaction, your bank or card issuer may place a temporary hold. Contact your financial institution if this persists.

7. Passes & Memberships

Merchants may offer session passes or memberships through the Platform. These are valid only for the specific merchant who issued them, for the duration and services stated. Passes are non-transferable unless otherwise indicated. Expiry and usage terms are set by the merchant.

8. AI-Powered Features

Switch uses AI to offer personalised insights and recommendations based on your activity on the Platform. These insights are designed to help you discover services you'll love and track your wellness journey. AI-generated insights are informational in nature and should not be treated as professional health, fitness, or medical advice.

9. Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose.
Impersonate any person or entity or misrepresent your affiliation.
Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
Post false, misleading, or harmful content.
Interfere with the normal operation of the Platform or other users' experience.

Violations may result in suspension or permanent removal of your account.

10. Intellectual Property

All content, branding, code, and design on the Switch Platform are owned by or licensed to Switch. You may not reproduce, distribute, or create derivative works without our express written permission. Content you create (e.g., profile information) remains yours — you grant Switch a limited licence to display it within the Platform.

11. Limitation of Liability

Switch provides the Platform on an "as available" basis and makes no warranties about uninterrupted access. To the fullest extent permitted by law, Switch shall not be liable for:

The quality, safety, or suitability of any service provided by a merchant.
Losses arising from merchant cancellations, service changes, or conduct.
Indirect, incidental, or consequential damages arising from use of the Platform.

Our total liability in any matter is limited to the amount you paid for the specific booking in question.

12. Indemnification

You agree to indemnify Switch against any claims, damages, or expenses arising from your violation of these Terms, misuse of the Platform, or infringement of any third-party rights.

13. Termination

You may close your account at any time. Switch reserves the right to suspend or terminate accounts that violate these Terms or that are inactive for an extended period, with reasonable notice where appropriate.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

15. Changes to These Terms

We may update these Terms to reflect changes in our services or legal requirements. We will notify you of material changes via in-app notification or email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
